Council denies Garden Café appeal

By Brue Felps

There will be no adult libations, either sold by or brought into, Garden Café.

According to a piece in today’s newsprint version of Dallas Morning News, Dale Wootton and his Junius Heights establishment lost an appeal to Dallas City Council to override the City Plan Commission’s denial of a special use permit to allow beer and wine sales.

The permit, said city officials, couldn’t stop with allowing beer and wine sales. It would also include liquor. Opposition among neighborhood residents cited potential liquor sales by future owners should Garden Café ever shut down or move.

The SUP would stay with the property not Garden Café, and residents opposed potential liquor sales by unknown proprietors.

In the process, Wootton found that allowing BYOB libations during evening events — after regular café hours  — hosted by neighborhood groups or arts patrons violated city ordinance, so now that avenue closed down as well.
